This document informs the responsibilities, duties and obligations that every user assumes when accessing and/or using the OpenPix platform including its related services such as Software, Code, Complements, Plugins, Sites, Manuals, Documents and accessories.

It is important that you read the guidelines below to enjoy the best way the services made available.

OUR SERVICES

OpenPix is a payment method management platform. It has several functionalities such as: Generation of QR Codes, Control and transaction authentication, encryption key management, APIs, Access control, file transfer, management and registration of customers, sending invoices by email or message.

All the services we offer on the platform are intended to optimize the financial processes of companies, facilitating communication, collection, management and sending of amounts digitally between the company and your customers.

The platform has service modules that are free or that can be purchased separately, according to the needs of each company and will be made available as contracted.

PLATFORM USE AND RESPONSIBILITIES

User account, password and security:

To register with OpenPix it is necessary to complete the registration, providing up-to-date, complete and true information requested at the time of registration. In addition, it is mandatory to keep this information updated.

When the user chooses to register on the OpenPix platform, clarifies that it is technically impossible for users to choose how login to register words, expressions or graphic sets denominations that have already been previously chosen by other Registered users. Usage permissions

In order to take advantage of the platform's services, users must grant us permission for: Sending automated emails, messages via notifications and alerts for actions taken on the platform itself, access to cell phone camera or your browser, data sharing with system national finance, location, credit bureaus and mechanisms anti fraud.

The user agrees to always use the most current version of the platform and grants permission for the automatic installation of improvements and system updates in order to constantly optimize the experience of use both in the app and on the web. Users or clients, or access via APIs that do not meet minimum security, functionality requirements or encryption based on widely used security standards recognized in the industry will not be supported and access will be denied.

Use of Other Sites

The OpenPix platform may contain links to other sites operated by the 3rd. Thus, when accessing and using these sites, their information, materials, products and or services, the User is doing so at his/her own risk.

ANTISPAM POLICY

The OpenPix platform will use its best efforts to prevent sending unsolicited unsolicited e-mails unrelated to the user. GENERAL PROHIBITIONS

By registering or using the platform, you agree to:

The service, website, application, plugins, software and all Rights of Intellectual Property on this, are owned by OpenPix its controlled and or affiliated. All rights to software not have been expressly granted to the user in this term are expressly reserved to OpenPix, its subsidiary and/or affiliates without restriction, including, but not limited to, the exclusive right to property. Without prejudice to the above, the user agrees to not to do or allow others to do: (a) sublicense, distribution or use of the service or software outside the scope granted under this term; (b) copy, modify, adapt, translate, generate works derivatives, reverse engineer, disassemble or decompile the software, or otherwise attempt to discover any source code or other service-related trade secret; (c) rent, lease, sell, assign or in any way transfer rights over the software or on the service; (d) use, post, transmit or introduce any device, software or routine that interferes with or attempts to interfere with the operation of the Service or the software; (e) use the Marks, trade names, service marks, logos, domain names, and other distinctive signs or any copyright or other rights owners associated with the service for any purpose, without the OpenPix's express written consent; (f) register, try register or assist any person to register any trademarks, names trademarks, trademarks, service marks, logos, names of domain, and other distinctive signs, copyright or other right owner associated with OpenPix or (g) remove, omit or alter any copyright notice, trademarks, or any rights owners shown on any item included in the service.

INDEMNITY

To the fullest extent permitted by law, you will indemnify, hold harmless liability and will defend OpenPix, at its expense, from any third-party claims, actions, processes and demands filed against OpenPix or any of its directors, employees, representatives or affiliates, and against all liabilities, damages, agreements, penalties, fines, costs or related expenses (including reasonable attorney fees and other litigation expenses) incurred by OpenPix or any of its directors, employees, representatives or affiliates, arising out of or relating to (i) breach by the user of any of the terms or conditions of this term; (ii) use made by the user, (iii) violation of laws, regulations and rules applicable to the user of the service, (iv) any representations and warranties made by the user with respect to any aspects of the OpenPix website and application, service and software; (v) any claims made by or on behalf of any third parties relating to directly or indirectly with the use of OpenPix performed by the user; It is (vi) violations of user privacy obligations.

BREACH OF TERMS OF USE

Failure to comply with the conditions, terms and observations of this term confers OpenPix the right to cancel, suspend, delete and or disable the account or the material sent by the user, temporarily or permanently, at its sole and exclusive discretion, without prejudice to the legal provisions relevant and without the need to inform the user of the action taken inside your system.

MODIFICATIONS TO THE TERMS OF SERVICE AND OTHER POLICIES

OpenPix is constantly optimizing its services and developing new features to better serve you. TERM AND TERMINATION

This term has an indefinite duration, and may be terminated at any time by OpenPix. If you wanted to be excluded from the platform at any time, please contact company contracting the OpenPix service.

GENERAL PROVISIONS

The provisions contained in this instrument represent the entire understanding between the user and OpenPix and supersedes all and any prior understandings and representations between the parties. Case any provision of this instrument is considered invalid or null for whatever reason, this nullity will not affect the other provisions of the instrument, maintaining the intentions of the parties in the rest of the instrument.

APPLICABLE LAW

This document is governed by and must be construed in accordance with the law of protection of personal data of the Federative Republic of Brazil.

IMPORTANT
